Einkaufskooperationen im deutschen Gesetz gegen Wettbewerbsbeschränkungen aus
ökonomischer Sicht. Sie beantwortet die Frage, ob es dem Gesetzgeber gelungen ist, die
positiven Wirkungen von Einkaufskooperationen zu fördern und gleichzeitig die
negativen Effekte zu unterbinden. Auf rechtspolitische Fragen geht sie dabei nur im
Ansatz ein. Das zweite Kapitel der Arbeit stellt zu diesem Zweck zunächst dar, was eine
Einkaufskooperation is t, welche Typen es gibt, welche Bedeutung sie haben und auf
welchem theoretischen Hintergrund diese zu beurteilen sind. Insbesondere entwickelt
dieses Kapitel einen Katalog von Beurteilungskriterien, anhand derer die Wirkung von
Einkaufskooperationen und auch die rechtlichen Normen zu beurteilen sind.
Das dritte Kapitel erörtert differenziert die ökonomische Wirkung von
Einkaufskooperationen jenseits der rechtlichen Normen des GWB und arbeitet die
positiven und negativen Folgen auf den Wettbewerb, aber auch Auswirkungen
allgemein volkswirtschaftlicher Art heraus.
Das vierte Kapitel erläutert das Regelwerk, dem der Gesetzgeber
Einkaufskooperationen unterworfen hat. Der Schwerpunkt liegt auf dem § 4(2) GWB,
der die Freistellung von Einkaufskooperationen im deutschen Recht regelt. Da auch das
europäische Recht auf inländische Einkaufskooperationen anwendbar ist, geht die
Arbeit ebenso auf das europäische Recht der Einkaufskooperationen ein.
Das fünfte Kapitel arbeitet heraus, wie die Regelungen des GWB aus ökonomischer
Sicht zu beurteilen sind : Sind diese in der Lage die ökonomisch positive Wirkung von
Einkaufskooperationen herauszustellen und gleichzeitig die negativen Effekte
auszuschließen? Besonders die Auswirkungen auf die in Kapitel zwei aufgestellten
Beurteilungskriterien werden überprüft.
Das sechste Kapitel fasst die Ergebnisse der Arbeit thesenartig zusammen.
