Ein grundlegendes Kriterium für die Definition einer politischen Einheit ist die potentielle Fähigkeit zur Konfliktlösung innerhalb derselben. Hierbei bezieht Moore sich insbesondere auf Evans-Pritchard.
Daraus resultiert, dass Recht stets in seinem sozio-kulturellem Rahmen betrachtet werden muss. Selbsthilfe, kollektive Verantwortung und Talionsprinzip bzw. direkte Hilfe illustrieren den sozialen und politischen Kontext, in dem rechtliche Verpflichtungen gesehen werden müssen.
Basis für Recht in vorindustriellen Gesellschaften ist das Gruppenprinzip, das zwar nicht das einzige, jedoch das dominierende Prinzip in diesen Gesellschaften ist und alle anderen Formen von sozialen Beziehungen überschattet.
In einigen vorindustriellen Gesellschaften reagiert in bestimmten Fällen die ganze Gemeinschaft gegen eine Gefahr, die groß genug erscheint, die Existenz der Gesellschaftsordnung zu bedrohen. Wird in jenen Fällen auch die ganze Gemeinschaft aktiv, so heißt dies jedoch nicht, dass bereits eine Vorstellung von öffentlichem Recht existiert. Dennoch lässt es sich hierbei von einer Art von Rechtsorganisation sprechen, da die zentrale Wirklichkeit des vorindustriellen Rechts in der Solidarität der Gruppe beschlossen liegt. Das Individuum kann Rechte so gut wie ausschließlich nur als Mitglied einer Gruppe inne haben, der einzelne kann nur in irgendeiner Form von Gruppenbildung
Schutz finden.
